Divorci: defensa i retirada de les nostres esmenes a favor de les pactades amb les altres grups

Aquí podeu llegir les notes que van servir de base per a la meva intervenció en el Ple del Senat de dimecres 22 de maig en defensa de les nostres esmenes i explicant en cadascun dels casos perquè les retiràvem, després d'haver aconseguit un acord amb el PSOE sobre la necessitat que, en les demandes de guàrdia i custòdia a demanda de part, l'informe del fiscal fos preceptiu, però no obligatòriament favorable. En algún cas, com el de l'apartat 7 de l'article 92 del Codi Civil, vam retirar les nostres esmenes malgrat que podrien haver estat aprovades amb el suport del PP però sense el del PSOE i, per tant, amb molt poques possibilitats de prosperar després en el tràmit del Congrés:

Las enmiendas que hemos presentado y las enmiendas transaccionales que hemos firmado parten de un acuerdo fundamental con el contenido de esta Ley en la medida que representa un progreso indiscutible en la regulación del derecho a la separación y el divorcio i que refuerza el principio de libertad de cada uno de los cónyuges en el matrimonio.

Al presentar nuestras enmiendas y al intentar llegar acuerdos con otros grupos hemos sido muy conscientes del contexto social y político en que estamos, y del hecho que la Ley llega al Senado después de un intenso trabajo del Gobierno y del Congreso, que a nosotros nos corresponde perfeccionar en la medida de lo posible. Es decir que no estamos aquí para definir unos modelos ideales, sino para perfeccionar un instrumento jurídico que facilite la resolución de los conflictos, sobretodo que no los complique, y que asegure una adecuada protección de los derechos e intereses de cada uno de los cónyuges, pero sobretodo los de los menores, los de los niños y niñas que con el divorcio también en la medida de lo posible no deberían perder y en lo posible deberían ganar, ganar un marco afectivo y de convivencia estable, conservar e incluso mejorar los vínculos tanto con la madre como con el padre, necesarios para el pleno desarrollo de su personalidad.

Somos concientes de los límites de la reforma que hoy debatimos, pero tampoco la Ley puede ni debe ir muy por delante de los usos sociales. En este sentido estamos convencidos que en pocos años deberemos introducir nuevas reformas que perfeccionen el Código Civil en esta materia ya que, en la medida que la igualdad del hombre y la mujer sea más efectiva en la sociedad y en la vida familiar, también el divorcio evolucionará en sentido positivo, como lo está haciendo ya con esta reforma.

Hemos mantenido hasta el día de hoy cinco enmiendas:

La número 5 (la númeració és la que li van donar en la publicació oficial de les esmenes) tenía como finalidad por un lado eliminar la idea de excepcionalidad de la demanda de la guardia y custodia compartida a instancia de parte, es decir cuando no existe un acuerdo previo de los padres, y por otro no limitar la capacidad jurisdiccional del juez con la exigencia del informe favorable del Ministerio Fiscal, al que se otorgaba de esta manera una capacidad de decisión que desde nuestro punto de vista no le es propia en nuestro ordenamiento jurídico. Finalmente retiraremos nuestra enmienda 5 a favor de la enmienda transaccional que hemos firmado todos los grupos menos el PP, que creemos que recoge el espíritu fundamental de nuestra enmienda de posibilitar que el juez acuerde la guardia y custodia compartida cuando de esta manera se protejan mejor los intereses de los menores, que comprenden también la conservación y si es posible la mejora de los vínculos de convivencia con su madre y con su padre, con los adultos que habían sido hasta el momento de la separación referentes fundamentales en el marco familiar para su desarrollo, cuando esto haya sido efectivamente así. La transacción que hemos firmado enmarca mejor la decisión del juez, que deberá considerar para otorgar la guardia compartida en este caso la idoneidad de la ubicación de los domicilios de los padres y que contará necesariamente para tomar la decisión no solo con las orientaciones del informe del Ministerio Fiscal sino con las del dictamen de un equipo psicoasistencial.

No hemos conseguido quitar la palabra excepcionalmente pero creemos que esta no puede ser óbice en ningún caso para que el juez admita a trámite la demanda de guardia y custodia compartida y por lo tanto luego en el procedimiento verá si, dadas las circunstancias del caso, el procedimiento debe continuar hasta conceder la guardia y custodia compartida, o no, con las condiciones que estime pertinentes una vez escuchadas todas las partes y atendido los informes y dictámenes preceptivos.

Paso a nuestra enmienda número 6. Estando de acuerdo con el contenido fundamental del apartado 7 del artículo 92 que dice que no procederá la guarda conjunta cuando cualquiera de los padres esté incurso en un proceso por violencias o por atentar contra la libertad del otro cónyuge o de los hijos, con esta enmienda intentábamos dejar claro que esta decisión es revisable, de acuerdo con el artículo 775 de la Ley de Enjuiciamiento Civil, con la finalidad de poner alguna cortapisa a las denuncias falsas, al margen de la consideración penal que puedan merecer.

Tampoco nos parecía procedente la segunda parte de este apartado 7 que dice que tampoco procederá la guarda conjunta cuando el Juez advierta la existencia de indicios fundados de violencia doméstica. En realidad esta cautela no es necesaria porque en ese caso el Juez, de acuerdo entre otros con el artículo 49bis de la Ley de Enjuiciamiento Civil, adicionado por la Ley de protección contra la violencia de género, debe abrir diligencias contra la persona supuestamente agresora que pasará a estar incursa en un proceso por violencia, circunstancia contemplada en la primera parte de este apartado 7 del artículo 42.

La verdad es que nos hubiera gustado transaccionar esta enmienda con los demás grupos de esta cámara, especialmente con el grupo del Gobierno promotor de estas reformas, pero no ha sido posible. Por este motivo, visto por otro lado que hemos conseguido transaccionar un importante paquete de enmiendas con los demás grupos de esta Cámara y atendiendo al hecho que Entesa Catalana de Progrés está formada por senadores socialistas catalanes, de Esquerra Republicana y de Iniciativa per Catalunya Verds, hemos decidido retirar estas enmiendas números 6 y 7.

En honor a toda la verdad he de decir que senadores del Grupo Popular desde la primera reunión en que empezamos a examinar esta ley en el Senado mostraron su acuerdo con el contenido esencial de nuestras enmiendas de este apartado 7 del artículo 92 y que la portavoz del Grupo Popular en esta materia ha hecho un importante esfuerzo para incluso mejorar el redactado de nuestra enmienda y para intentar llegar a una transacción, se lo agradezco muy sinceramente, pero como ve cuestiones de oportunidad política nos llevan a retirar esta enmienda que creemos que mejoraba la Ley pero que sin ella nos parece que sigue siendo una buena Ley.

Por lo que se refiere a las enmiendas 8 y 9, he de precisar que eran enmiendas del Grupo IU-ICV en el Congreso que en virtud del acuerdo de constitución de la Entesa hemos presentado en el Senado a petición de ICV pero que dado que se correspondian exactamente con las de IU ha sido la senadora López Aulestia quien las ha defendido en su tramite en el Senado. Dado que la enmienda número 8 se ha tenido en cuenta en la transacción del redactado de algunos apartados del art. 92 la retiramos y a la vista que la senadora López Aulestia ha llegado a un acuerdo transaccional con el Grupo Popular y el Grupo de Senadores Nacionalistas Vascos i CiU sobre el Fondo de Garantía al que se refería nuestra enmienda número 9, la retiramos también dejando bien claro que los grupos que forman la Entesa votaremos en consonancia con el sentido del voto que hubo sobre este extremo en el Congreso de los Diputados.

Así pues, señor presidente, retiramos por motivos distintos todas nuestras enmiendas y votaremos favorablemente las que hemos transaccionado.
