Sobre la llei del divorci
Han passat molts dies des de la publicació de l'anterior "post". La veritat és que m'ha desbordat la feina relacionada amb les ponències, reunions de comissió, compareixences, reunions amb col·lectius diversos... en relació amb les lleis de modificació del Codi Civil pel que fa al matrimoni i al divorci, a banda de la modificació de la llei que regula l'assistència jurídica gratuïta.
Per ara, estic molt satisfet de la nostra intervenció en la Llei del divorci perquè em sembla que hem aconseguit millorar substancialment el text que ens va arribar del Congrés dels Diputats.
Aniré penjant la informació en "posts" successius per si en voleu seguir esquemàticament el procés. El principal debat se situava al voltant de l'article 92 del Codi Civil i especialement del seu apartat 8 que regula la possiblitat que el jutge pugui resoldre la guàrdia i custòdia compartida a instància d'una de les parts. A continuació trobareu el que deia el Projecte de Llei, els articles que ens semblaven més millorables, quan ens va arribar del Congrés de Diputats i les esmenes que hi vam presentar:
Hem subratllat en el text els apartats als qual vam presentar esmenes:
«Artículo 92 (redactat que ens va arribar del Congrés, que havia modificat el text primer del Govern, que en alguns aspectes, i especialment pel que fa a l'apartat 8, ens agradava més).
1. La separación, la nulidad y el divorcio no eximen a los padres de sus obligaciones para con los hijos.
2. El Juez, cuando deba adoptar cualquier medida sobre la custodia, el cuidado y la educación de los hijos menores, velará por el cumplimento de su derecho a ser oídos.
3. En la sentencia se acordará la privación de la patria potestad cuando en el proceso se revele causa para ello.
4. Los padres podrán acordar en el convenio regulador o el Juez podrá decidir, en beneficio de los hijos, que la patria potestad sea ejercida total o parcialmente por uno de los cónyuges.
5. Se acordará el ejercicio compartido de la guarda y custodia de los hijos cuando así lo soliciten los padres en la propuesta de convenio regulador o cuando ambos lleguen a este acuerdo en el transcurso del procedimiento. El Juez, al acordar la guarda conjunta y tras fundamentar su resolución, adoptará las cautelas procedentes para el eficaz cumplimiento del régimen de guarda establecido, procurando no separar a los hermanos.
6. En todo caso, antes de acordar el régimen de guarda y custodia, el Juez deberá recabar informe del Ministerio Fiscal, y oír a los menores que tengan suficiente juicio cuando se estime necesario de oficio o a petición del Fiscal, partes o miembros del Equipo Técnico Judicial, o del propio menor, valorar las alegaciones de las partes vertidas en la comparecencia y la prueba practicada en ella, y la relación que los padres mantengan entre sí para determinar su idoneidad con el régimen de guarda.
7. No procederá la guarda conjunta cuando cualquiera de los padres esté incurso en un proceso penal iniciado por atentar contra la vida, la integridad física, la libertad, la integridad moral o la libertad e indemnidad sexual del otro cónyuge o de los hijos que convivan con ambos.
Tampoco procederá cuando el Juez advierta, de las alegaciones de las partes y las pruebas practicadas, la existencia de indicios fundados de violencia doméstica.
8. Excepcionalmente, aun cuando no se den los supuestos del apartado cinco de este artículo, el Juez, a instancia de una de las partes, con informe favorable del Ministerio Fiscal, podrá acordar la guarda y custodia compartida fundamentándola en que sólo de esta forma se protege adecuadamente el interés superior del menor.
9. El Juez, antes de adoptar alguna de las decisiones a que se refieren los apartados anteriores, de oficio o a instancia de parte, podrá recabar dictamen de especialistas debidamente cualificados, relativo a la idoneidad del modo de ejercicio de la patria potestad y del régimen de custodia de los menores.»
ENMIENDA NÚM. 5 Del Grupo Parlamentario Entesa Catalana de Progrés (GPECP)
ENMIENDA
De sustitución.
Se propone el siguiente redactado del apartado 8 del artículo 92:
«8. Cuando no se den los supuestos del apartado cinco de este artículo, el Juez, a instancia de una de las partes, previo informe del Ministerio Fiscal, podrá acordar la guarda y custodia compartida si de esta forma se protege mejor el interés superior del menor.»
JUSTIFICACIÓN
En materia de guardia y custodia compartida debe primar el interés del menor como criterio rector de la decisión judicial.

ENMIENDA NÚM. 6 Del Grupo Parlamentario Entesa Catalana de Progrés (GPECP)
ENMIENDA
De modificación.
Se propone el siguiente redactado del primer párrafo del apartado 7 del artículo 92 del Código Civil:
«7. No procederá cautelarmente la guarda conjunta cuando cualquiera de los padres esté incurso en un proceso penal iniciado por atentar contra la vida, la integridad física, la libertad, la integridad moral o la libertad e indemnidad sexual del otro cónyuge o de los hijos que convivan con ambos; sin perjuicio de la revisión de la resolución en materia de guarda y custodia en los supuestos de sobreseimiento o absolución posteriores.»
JUSTIFICACIÓN
La reparación de los derechos del justiciable en los casos de sobreseimiento o absolución por los delitos a que se refiere el apartado 7 del artículo 92 hace imprescindible que se garantice el derecho a la revisión de la medida denegatoria adoptada de manera cautelar, ya que de otra manera se lesiona el derecho constitucional de inocencia del padre o madre imputados.
ENMIENDA NÚM. 7 Del Grupo Parlamentario Entesa Catalana de Progrés (GPECP)
ENMIENDA
De supresión.
Se propone la supresión del segundo párrafo del apartado 7 del artículo 92 del Código Civil.
JUSTIFICACIÓN
El redactado actual vulnera las garantías procesales de las partes intervinientes en el proceso. Si existe cualquier indicio fundado de violencia doméstica, la obligación del Juez, por imperativo legal, es la de proceder contra el presunto autor, sea mediante la instrucción del procedimiento de naturaleza penal correspondiente, sea mediante comunicación al Ministerio Fiscal o al órgano instructor que sea competente. Únicamente la valoración de las pruebas practicadas, y no las meras alegaciones de parte, pueden fundamentar la resolución judicial.
Adicionalmente, la concurrencia de antecedentes de violencia doméstica en uno de los padres resulta incompatible con la protección superior del interés del menor, y, por tanto, con la autorización de la guarda compartida.

De sustitución.
Artículo 92.
Se propone sustituir el artículo 92 por el siguiente texto:
«Artículo 92.
La separación, la nulidad y el divorcio no eximen a los padres de sus obligaciones para con los hijos.
Las medidas judiciales sobre la custodia, el cuidado y la educación de los hijos menores serán adoptadas en beneficio de ellos, previo informe del Ministerio Fiscal y tras oír a los mayores de 12 años y a los menores que tengan el suficiente juicio.
En la sentencia se acordarán medidas en relación con los siguientes extremos:
a) La privación de la patria potestad cuando en el proceso se revele causa para ello.
b) Que la patria potestad sea ejercida total o parcialmente por uno de los cónyuges.
c) Que la guarda de los hijos sea ejercida por uno de ellos o conjuntamente ejercida de forma alterna, adoptándose las cautelas procedentes para el eficaz cumplimiento del régimen de guarda. En caso de guarda conjunta ejercida de forma alterna, se deberá fijar con precisión el modo en que se armonizará la actuación de ambos progenitores, y si procede, determinará los sucesivos períodos temporales en que cada progenitor deberá guardar a los hijos.
No procederá la guarda conjunta ejercida de forma alterna cuando cualquiera de los padres esté incurso en un proceso penal iniciado por atentar contra la vida, la integridad física, la libertad, la integridad moral o la libertad o
indemnidad del otro cónyuge o de los hijos que convivan con ambos.
Tampoco procederá cuando el Juez advierta, de las alegaciones de las partes y las pruebas practicadas, la existencia de indicios fundados de violencia doméstica.
En todo caso, se procurará no separar a los hermanos.
El Juez, antes de adoptar alguna de las decisiones a que se refieren los apartados anteriores, de oficio o a instancia de parte, podrá recabar un dictamen de especialistas relativo a la idoneidad del modo de ejercicio de la patria potestad y del régimen de custodia de los menores.»
JUSTIFICACIÓN
La redacción del artículo 92 del Proyecto de Ley no resulta satisfactoria por cuanto genera cierta ambigüedad en torno al papel del Juez a la hora de dictar medidas judiciales sobre los hijos. En este sentido, resulta esencial considerar dos aspectos:
1. Debe quedar claro que el «interés de los hijos» (en cuanto interés de los menores) debe ser el criterio rector sobre la medidas que se acuerden sobre ellos. Así aparece recogido no sólo en los Convenios internacionales aplicables al caso (Convenio sobre los Derechos del Niño de 1989, entre otros), sino también en la propia normativa interna española (Ley Orgánica 1/1996 de Protección Jurídica del Menor, especialmente artículos 2 y 11.2).
2. La autoridad judicial debe tener, en todo caso, la última palabra en relación con las medidas que se vayan a adoptar sobre los hijos, por encima e, incluso, en contra, del propio acuerdo de los padres. Éste es otro de los principios esenciales rectores en materia de menores, que hace primar el aspecto obligacional de las relaciones paterno-filiales.
3. Resulta más adecuado emplear los términos «guarda conjunta ejercida de forma alterna», porque pone el énfasis en la permanente corresponsabilidad de los progenitores sobre todas las incidencias de los hijos comunes y refleja el hecho de que físicamente la guarda o la permanencia es alterna.
4. Para evitar que la guarda conjunta acabe traduciéndose en una situación caótica para el menor, sería conveniente que la ley obligara al Juez en cuanto a los pronunciamientos que pueda hacer en Sentencia.
